1. Agreement to terms

By accessing or using the Maximiser.ai websites, mobile or web applications, dashboards, APIs, early-access experiences, or related services (collectively, the “Services”), you (the user / recipient of the services) agree to be bound by these Terms of Use (“Terms”), our Privacy & Cookie Policy, and any additional terms presented for specific features (for example earner programs, enterprise agreements, or beta labs). If you do not agree, do not use the Services.

If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity, in which case “you” refers to the entity and its users.


2. Changes to the Terms

RNMLLP may modify these Terms at any time by posting an updated version with a new effective date. Where required by law, RNMLLP will provide additional notice or obtain consent. Your continued use after the effective date may constitute acceptance where permitted. If you do not accept changes, you must stop using the Services and, where available, close your account according to Section 18.


3. Eligibility

You must be at least the age of digital consent in your jurisdiction (commonly 18 in India for many contracts. You must not be barred from using the Services under applicable law (for example sanctions lists). You must provide accurate registration information and keep it updated.


4. Description of the Services

Maximiser.ai provides informational tools, dashboards, AI-assisted explanations, card and rewards intelligence, and optional location-aware or partner features as RNMLLP may offer from time to time. Features may be experimental, beta, or changed without notice except where law requires notice.

The Services are not financial, investment, tax, legal, or accounting advice. RNMLLP is not a bank, broker-dealer, investment adviser, credit repair organization, or law firm. Card issuer terms and conditions govern your relationship with issuers. You are solely responsible for decisions you make after using the Services.


5. Accounts, credentials, and security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must:

  • Use a strong password and enable 2FA where offered;
  • Notify RNMLLP promptly at contact@maximiser.ai if you suspect unauthorized access;
  • Not share accounts in ways that violate these Terms or circumvent technical limits.

RNMLLP may suspend or terminate accounts that appear compromised or abusive.


6. Acceptable use

You agree not to:

  • Violate any law or third-party right (including intellectual property, privacy, and publicity rights);
  • Attempt to probe, scan, or test the vulnerability of any RNMLLP system without written permission;
  • Bypass rate limits, paywalls, access controls, or authentication;
  • Scrape the Services at scale, mirror RNMLLP content for competitive purposes, or resell access unless expressly permitted in a separate agreement;
  • Upload malware, excessive payloads, or content designed to disrupt the Services;
  • Impersonate another person or misrepresent your affiliation;
  • Use the Services to stalk, harass, or harm others;
  • Reverse engineer the Services except to the extent mandatory law permits interoperability;
  • Use the Services to train competing machine learning models on RNMLLP outputs without written permission;
  • Circumvent geographic restrictions or export control laws.

RNMLLP may investigate violations and cooperate with law enforcement where permitted.


7. User content and license to RNMLLP

If you submit text, URLs, files, feedback, or other materials (“User Content”) through features such as earner submissions, support tickets, or surveys, you represent that you have the rights to submit that content and that it does not violate law or third-party rights.

You grant RNMLLP a non-exclusive, worldwide, royalty-free license to host, reproduce, modify (for formatting or moderation), display, and distribute User Content as needed to operate, improve, secure, and promote the Services, and to create aggregated non-identifying analytics. Moral rights are waived to the extent permitted by law.

RNMLLP may remove User Content that violates these Terms or poses risk, without obligation to monitor all submissions.


8. Intellectual property

The Services, including software, text, graphics, logos, layouts, and Maximiser.ai branding, are owned by RNMLLP or its licensors and protected by copyright, trademark, and other laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

You may not use RNMLLP trademarks in a way that suggests endorsement of third-party products without written permission.


9. Third-party services and links

The Services may link to or integrate with banks, card issuers, Plaid or other aggregators, maps providers, payment processors, social networks, or app stores. Those services are governed by third-party terms. RNMLLP is not responsible for third-party content, availability, or practices.


10. AI-generated outputs and errors

Certain features use artificial intelligence or rules engines to generate text, rankings, or suggestions. Outputs may be incorrect, incomplete, out of date, or biased. You must independently verify important information with issuers and official sources. RNMLLP does not warrant that outputs meet any accuracy standard suitable for regulated decisions.


11. Subscriptions, fees, trials, and taxes

If RNMLLP offers paid plans, trials, or consumption-based billing, the pricing page and checkout flow control fees, renewal, cancellation, and refunds unless mandatory consumer law provides otherwise. You are responsible for taxes associated with your purchases .

12. Early access and waitlist programs

If you join an early access list, you consent to RNMLLP using your submitted contact details to communicate about the Services subject to the Privacy & Cookie Policy and any marketing consents you provide. RNMLLP does not guarantee admission order, timeline, or feature availability.


13. Earner, partner, or incentive programs

Separate program rules may apply to earners or partners, including payout thresholds, tax documentation, content standards, and fraud checks. If program rules conflict with these Terms on program-specific points, the program rules control for that program only.


14. Privacy

Your use of the Services is subject to the Privacy & Cookie Policy, which explains how RNMLLP processes personal data. If you do not agree to the Policy, do not use the Services.


15. Confidentiality of non-public RNMLLP information

If RNMLLP provides you non-public documentation, credentials, or roadmaps under NDA or beta terms, you must protect that information and not disclose it without permission.


16. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RNMLLP DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.


17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • RNMLLP AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
  • RNMLLP’S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID RNMLLP FOR THE SERVICES IN THE 3 (3) MONTHS BEFORE THE CLAIM, OR (B) INR 3,000 (or equivalent), unless a mandatory statute sets a different non-waivable floor.

18. Indemnity

You will defend, indemnify, and hold harmless RNMLLP and its affiliates, directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your violation of these Terms or law; (c) your misuse of the Services; or (d) disputes between you and a third party (including issuers or merchants) arising from your reliance on the Services.


19. Suspension and termination

RNMLLP may suspend or terminate your access to the Services at any time, with or without notice, for conduct that RNMLLP believes violates these Terms or creates risk. You may stop using the Services at any time. Upon termination, Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, dispute resolution, and governing law) will survive.


20. Export controls and sanctions

You may not use or export the Services in violation of Indian export laws or other applicable sanctions programs. You represent that you are not located in a comprehensively embargoed jurisdiction and not on restricted party lists, unless RNMLLP explicitly approves in writing.


21. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws, subject to non-waivable consumer protections where you reside.

Informal resolution: Before filing a claim, the parties will attempt to resolve disputes in good faith by contacting contact@maximiser.ai.


22. Class actions and jury trials

To the extent permitted by applicable law, disputes must be brought only in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.


23. Communications and electronic notices

You consent to receive electronic communications from RNMLLP regarding the Services, including transactional messages and, where permitted, marketing. You may opt out of marketing as described in the Privacy Policy.


24. Force majeure

RNMLLP is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, terrorism, labor disputes, internet outages, supplier failures, or government actions.


25. Assignment

You may not assign or transfer these Terms without RNMLLP’s prior written consent. RNMLLP may assign these Terms in connection with a merger, acquisition, or sale of assets, provided the assignee agrees in writing to honor these Terms.


26. Entire agreement; severability

These Terms, the Privacy Policy, and any feature-specific terms constitute the entire agreement regarding their subject matter. If any provision is held invalid, the remaining provisions remain in effect.


27. No waiver

Failure to enforce any provision is not a waiver of RNMLLP’s right to enforce it later.


28. Language

The English version of these Terms controls unless RNMLLP publishes a binding translation required by local law.


29. Open-source and third-party components

The Services may include open-source software under separate licenses. Those licenses govern only the respective components and do not override RNMLLP’s proprietary rights in the overall Services.


30. Competitive benchmarking

Unless you have a written enterprise agreement permitting benchmarking, you may not publish comparative performance tests of the Services without RNMLLP’s prior written consent, except where law prohibits such a restriction.


31. Feedback

If you provide suggestions or feedback, RNMLLP may use them without obligation to compensate you or keep them confidential, except where a separate signed agreement states otherwise.


32. Government users

If you are a government or public sector user, additional terms may apply under applicable procurement law.


33. Beta features and acceptable risk

Beta features may be unstable or withdrawn. You assume elevated risk when using beta features. RNMLLP may collect additional diagnostics during beta periods as described in the Privacy Policy.


34. No fiduciary relationship

Nothing in these Terms creates a fiduciary or advisory relationship. RNMLLP does not owe a fiduciary duty to you beyond the express contractual duties here and in the Privacy Policy.


35. Card issuer relationships

Issuers may change benefits, fees, or rules at any time. RNMLLP is not responsible for issuer decisions, posting delays, or merchant coding errors that affect rewards.


36. Affiliate and referral links

The Services may include affiliate or referral links. RNMLLP may earn compensation when you apply for products through those links. Such compensation does not necessarily influence editorial ordering, but RNMLLP will endeavor to maintain transparent disclosures where required by law.


37. Community conduct

If you participate in community features, you must treat others respectfully. RNMLLP may moderate content and suspend users for hate speech, harassment, doxxing, or illegal content.


38. Security research

If you discover a security vulnerability, report it responsibly to contact@maximiser.ai. Do not exploit vulnerabilities beyond what is necessary to demonstrate impact. RNMLLP does not promise a bug bounty unless a separate program is published.


39. Notices to RNMLLP

Legal notices should be sent to contact@maximiser.ai with “Legal Notice” in the subject line and, for formal service where applicable, to the registered address on file for RNMLLP.

40. Statutory rights

Nothing in these Terms limits non-waivable statutory rights of consumers under the Consumer Protection Act, 2019 or other laws. **


41. Insurance and reliance

You acknowledge that RNMLLP does not guarantee any insurance coverage for losses you may incur from using the Services. You should maintain appropriate insurance for your financial and operational risks.


42. Headings

Headings are for convenience only and do not affect interpretation.


43. Relationship with App Stores

If you download the Services through an app store, you acknowledge that the app store provider is not responsible for supporting the Services and may have its own terms. To the extent permitted by the app store rules, any conflict regarding liability between you and the app store provider is subject to that provider’s standard terms.


44. No third-party beneficiaries

Except as expressly stated, these Terms do not confer rights on any third party.


45. Interpretation

Ambiguities will not be construed against the drafter solely on that basis; [TODO: Indian counsel] adjust if local contra proferentem rules require.


46. Payment disputes with issuers or merchants

If you dispute a charge, reward posting, merchant category, or benefit denial, you must resolve that dispute directly with the issuer or merchant under their contracts and dispute procedures. RNMLLP may provide informational context but does not control issuer systems and is not a party to your cardmember agreement.


47. Accuracy of user-provided portfolio data

Recommendations and insights depend on the accuracy and completeness of data you supply. RNMLLP is not liable for outcomes arising from incorrect card selections, stale benefit parameters you entered manually, or misunderstood issuer rules.


48. Service levels and maintenance

Unless a separate SLA states otherwise, RNMLLP does not guarantee any uptime percentage, mean time to repair, or response time for support. RNMLLP may perform maintenance that temporarily limits availability.


49. Storage limits and fair use

RNMLLP may impose technical limits on storage, API calls, model usage, or number of linked cards based on your plan or abuse-prevention rules. Excessive automated use may be throttled or blocked.


50. Reverse engineering and competitive misuse

Except where mandatory law permits decompilation for interoperability, you may not disassemble, decompile, or otherwise attempt to extract source code or model weights from the Services. You may not use the Services to build a competing product that reproduces Maximiser.ai’s distinctive selection, coordination, and arrangement of features where that would infringe RNMLLP’s rights.


51. Publicity

Unless you opt out in writing or a feature provides an opt-out control, RNMLLP may use your name and logo on a customer list only if you are a business customer under a contract that expressly permits marketing references. For consumers, RNMLLP will not publicly identify you as a user without separate consent.

52. Independent contractors

RNMLLP’s suppliers and moderators are independent contractors, not employees, unless expressly stated otherwise. No agency, partnership, or joint venture is created by these Terms.


53. Severability of arbitration (if adopted)

If any portion of an arbitration clause is found unenforceable, the remainder should remain in effect to the maximum extent permitted.


54. Titles and definitions

Capitalized terms used in these Terms and not defined here may be defined in the Privacy & Cookie Policy or feature-specific addenda. In case of conflict in definitions, the document that last expressly defines the term for that context controls unless counsel harmonizes them.


55. Morality and public order

You must not use the Services for illegal gambling financing instructions, sanctions evasion, money laundering, terrorism financing, or other unlawful purposes. RNMLLP may preserve records and cooperate with authorities as required by law.


56. Accessibility of terms

RNMLLP aims to present these Terms in readable English. If you need a reasonable accommodation to access the Terms, contact contact@maximiser.ai.


57. No obligation to monitor

RNMLLP is not obligated to monitor all User Content but may do so to enforce these Terms, comply with law, or improve safety systems.


58. Pre-release features and confidentiality

If you access pre-release features under invitation, you may be subject to additional confidentiality obligations. Unauthorized disclosure of non-public roadmap details may result in termination and legal remedies where available.


59. Limitation on injunctive relief theories

Except for claims related to intellectual property infringement, misuse of trade secrets, or unauthorized access, each party agrees that equitable relief standards under applicable law apply; [TODO: Indian counsel] calibrate equitable relief language for Indian courts.


60. Currency and settlement

If fees are denominated in INR or other currencies, conversion and bank charges may apply based on your payment method issuer. RNMLLP may change pricing prospectively with notice where required.


61. No obligation to store communications

Unless law requires retention, RNMLLP may delete support chats, emails, or in-app messages according to retention schedules in the Privacy Policy.


62. Third-party beneficiary platform terms

Where app stores impose refund or family sharing rules, those rules may override inconsistent RNMLLP policies only to the extent required by the platform contract between you and the store.


63. Entire remedies

Except where non-waivable law provides otherwise, your exclusive remedy for dissatisfaction with the Services is to stop using them and cancel paid subscriptions according to the cancellation rules in effect at that time.


64. Relationship to specific card issuer trademarks

References to issuer or network names and marks are for identification only. Issuers do not sponsor RNMLLP unless expressly stated in writing for a particular campaign.


65. No guarantee of reward rates

Reward multipliers, bonuses, and categories change. RNMLLP does not warrant that any projection or example will materialize for your account.


66. Limitations on automated access to issuer sites

You must not configure the Services or third-party tools to log in to issuer portals on your behalf in ways that violate issuer terms, including robotic or high-frequency credential use, unless an issuer provides a documented API permitting that access. RNMLLP disclaims responsibility for account locks or fraud flags triggered by your automation choices outside RNMLLP’s official integrations.


67. Data portability and export

Where the Services provide export features, exports are provided as-is and may omit fields for security reasons. RNMLLP does not warrant that exports meet any regulatory archiving standard unless a B2B contract says otherwise.


68. No guarantee of feature parity across platforms

Web, iOS, and Android experiences may differ. RNMLLP may deprecate features on specific platforms. Your continued use of a platform constitutes acceptance of that platform’s feature set at that time.


69. Local law overrides in consumer transactions

If you are a consumer in India, certain unfair contract terms may be void under the Consumer Protection Act, 2019. [TODO: Indian counsel] review exclusions and liability caps for fairness under applicable rules.


70. Order of precedence among documents

If multiple documents apply, the order of precedence is: (1) a signed enterprise agreement between you and RNMLLP, if any; (2) program-specific rules for that program; (3) these Terms; (4) the Privacy & Cookie Policy for privacy matters; (5) general help-center articles (non-binding). 71. No bailment of funds

RNMLLP does not hold your money in a custodial capacity through the standard consumer Services. Payout flows, if any, occur through regulated payment partners under their terms.


72. Recording of support calls

If RNMLLP records support calls or video sessions for quality, RNMLLP will disclose recording at the start where required and describe retention in the Privacy Policy. [TODO: product] implement consent banners for recorded sessions.


73. No obligation to continue free tiers

RNMLLP may modify or discontinue free tiers, introduce limits, or require verification to prevent abuse. RNMLLP will provide reasonable notice where required by law or platform rules.


74. Survival of payment obligations

Termination does not relieve you of payment obligations accrued before termination for services already rendered or non-refundable fees permitted by law.


75. Counterparts and electronic signatures

If you enter a separate agreement with RNMLLP, electronic signatures and PDF counterparts may be valid to the extent permitted by law.


76. Tax and regulatory filings

You remain solely responsible for income tax, goods and services tax, or other tax filings arising from rewards, cashback, referral income, or partner payouts. RNMLLP may provide informational summaries but does not provide tax advice.


77. No guarantee of regulatory licensing status

Unless RNMLLP publishes a specific license registration for a regulated activity, you should assume the Services are non-regulated informational software. [TODO: counsel] update if RNMLLP obtains RBI or other registrations.
